These terms and conditions constitute the entire agreement between you and us in relation to your use of our website, and supersede all previous agreements in respect of your use of this website.

These terms and conditions will be governed by and construed in accordance with English law, and any disputes relating to these terms and conditions will be subject to the non-exclusive jurisdiction of the courts of Scotland.

(17) Payment and payment methods on the Website

We only accept payment for Orders in pounds (£) sterling.

We accept payment for orders by the payment options available at check out

If you choose to pay for your Order using a payment card with a foreign currency denominated account, the account will still be taken in pounds (£) sterling at the foreign exchange rate applied by your relevant credit card provider or bank at the time of processing your Order. Your international credit card provider or bank will determine the exchange rate and may add an additional processing or administration charge which you will be liable to pay.

By placing your Order and making an offer to buy a Product, you authorise us to transmit information (including any updated information) or to obtain information about you from third parties from time to time and this may include verification checks involving your debit or credit card number or credit reports in order to authenticate your identity, to validate your credit card, to obtain an initial credit card authorisation, to protect you and us from fraud; and to enable us to arrange delivery of your Order to your nominated delivery address.

CREDIT / DEBIT / CHARGE CARDS

Credit, debit and charge cards are accepted without surcharge.

When we receive your order and card payment, your order will be processed, many of our products are made to order and once this process has been initiated cancelation will not be possible.

We reserve the right to deliver any order to the cardholders billing address in the interests of protecting both the card holder and Bulkbag Containers Ltd against credit card fraud.

Orders sent to a non card registered address are sent at the customers liability due to the higher risk of card fraud and a third party obtaining your order when sending to a third party address. If requesting an alternative delivery address please state this on your order, along with your card registered address.

In the interests of protecting all our customers against credit card fraud, you may be asked to provide us with proof of your address at anytime. If you refuse to provide us with this evidence, your order may be cancelled.

If you are using a credit card not belonging to yourself, you must give the cardholder’s full name and address. We may then contact the cardholder to obtain approval.

The use of stolen credit cards will result in international police notification.

CHEQUES

Personal or business cheques are welcomed but clearance is required prior to order shipping. This can take up to 10 working days from when we receive the cheque.

Please note we only accept UK cheques.

Unfortunately we are unable to reserve items whilst waiting for cheque clearance.

IMPORTANT: Please ensure that you have written your full name and address on the back of the cheque together with your order reference.

CASH

You may transfer funds (or pay cash) directly into our bank account.

(18) Prices

We reserve the right to amend our prices without prior notice. All customers with outstanding orders will be notified of any change in prices before their order is charged and despatched.

All orders are accepted subject to availability of stock at the time of picking the order.

Prices are correct at the time of publication or upload to our website.

We are not obliged to supply goods to you until we have confirmed acceptance of your order. The acknowledgement email you may receive does not constitute order confirmation, or acceptance.

VAT and Non-EU Customs

All Products are subject to UK VAT. Prices are shown excluding VAT except where specified.

Where you have requested delivery of your Order to an EU country, the total cost of your Order will include UK VAT.

Where you have requested delivery of your Order to a non-EU country, the total cost of your Order will not include UK VAT.

You will be the importer for the international delivery of your Order (i.e. any Order delivered to a country other than the UK). Therefore, before placing an Order, it is your responsibility to check that the Products you are planning to import comply with state and federal government import regulations, and that there are no local requirements or restrictions which may affect receipt of your Order. If any customs requirements apply or charges are due, you agree to be responsible for these.

(19) Delivery

You must provide us with complete and accurate delivery address information. For the avoidance of doubt, this includes not only the address that your Order is going to, but also the name of its recipient. We cannot be liable for the delivery of your Order to the wrong address or the wrong person as a result of you supplying us with incomplete or inaccurate information.

All consignments will be delivered by us and will require a signature on delivery.

For stocked items and orders received before 12noon we aim to dispatch products on the same day (Monday to Friday). For bespoke / made to order items we aim for dispatch within 7 working days. Please note that delivery of your Order may take longer during busy periods.

International Delivery

International Delivery Destinations

You may request international delivery of your Order. For the purposes of these Terms and Conditions, we consider “international delivery” to relate to the delivery of your Order to a country outside of the UK. You may select the international delivery option at the checkout process by specifying a delivery address outside of the UK.

International Delivery Charges

We will notify you of the international delivery charge(s) applicable to your Order at the checkout and the amount will be added to the total amount of your Order.

International Delivery Lead Times

Delivery lead times of your Order to an international address will vary according to its destination. Deliveries to EU locations are automatically quoted as road freight, other international destinations are quoted as air freight.

We will make every effort to deliver your Order within the estimated timescales. However delays are occasionally inevitable due to unforeseen factors or events outside our control, for example, material shortages, travel or transportation disruption, import delays or higher than anticipated demand. Bulkbag Containers Ltd shall not be liable for any delay or failure by us to deliver your Order within the estimated timescales.

There may be additional import fees and duties to pay if you are purchasing the goods from outside of the EU, establishing these /  the payment of additional fees and duties will be the responsibility of the purchaser.
